More college freshmen view diploma as gateway to better job









College freshmen increasingly see higher education as a path to financial security during uncertain economic times, according to a UCLA-sponsored survey of first-year students across the nation.


A record high level of current freshmen cited getting a better job as a very important reason to pursue a college diploma: 87.9% of them, up about 17 percentage points from 2006, before the recession began. Making more money as a result of earning a bachelor's degree was key to 74.6% of them, rising from 69% six years ago, said The American Freshman survey released Thursday by UCLA's Higher Education Research Institute.


"With the recession going on, they have seen so many people losing jobs and hopefully have seen statistics that those with college degrees are much more likely to have jobs than people who don't have college degrees," said John H. Pryor, the study's main author and the institute's managing director.





The report also found increasing money pressures on college enrollment: 66.6% of freshmen said current U.S. economic conditions significantly affected their choices of colleges, compared with just over 62% two years ago when the question was first posed. Tuition and other expenses strongly influenced where they enrolled for 43.3%, up from 31% when first asked in 2004.


More students are living at home or with relatives: 17.2%, about 2 percentage points more than last year. And those who do so are less likely to borrow money or tap family resources to pay college bills, Pryor said.


The survey, now in its 47th year, is considered the nation's most comprehensive assessment of college students' attitudes. For Thursday's results, it polled 192,912 first-time full-time freshmen as they started the 2012 fall semester at 283 four-year colleges and universities around the country.


Students' personal life goals also seem partly shaped by money worries, with 81% saying that being "very well off financially" was essential or very important, a new record and double what it was 40 years ago during the hippie era. Yet, they also showed a philanthropic side: 72% said they wanted to help others in difficulty, 6 percentage points higher than both before the recent recession and in the mid-1970s.


Politically, 47.5% of freshmen identified themselves as middle-of-the-road, compared with 43.3% in 2008. That comes mainly from a decline in those who said they were liberal or far left, now 29.6%, while conservatives or far right students stayed about the same, 22.9%. However, support for liberal causes has risen, with 75% supporting gay marriage, 61.1% backing abortion rights and 64.6% thinking the wealthy should pay more taxes.


Freshmen reflect a wider trend away from ideological labels despite specific issues. "It's a general moving away from seeing yourself labeled as a liberal or conservative, a Democrat or Republican, and more likely to consider yourself as an independent who might vote Democratic or Republican," Pryor said.

LAPD grapples with responding to possible 'swatting' calls









Los Angeles police are recalibrating their response to some emergency calls in light of a series of prank "swatting" calls reporting violent incidents at the homes of celebrities such as Ashton Kutcher, Justin Bieber and now Chris Brown.


Officers will continue to respond immediately, in large numbers and with force if needed, to reports of crime at the homes of such VIPs, top Los Angeles Police Department officials said. But they are trying to warn officers more quickly in cases where an emergency call appears to have the hallmarks of swatting. Swatting is a prank call reporting a violent crime that results in a tactical police response that may include a SWAT team.


Deputy Chief Debra McCarthy, who oversees the LAPD's West Bureau, said that while the number of fake 911 calls about hostages or potential deadly violence at celebrities' homes is exceedingly low, officers are being cautioned to be aware of the possibility of swatting in a bid to limit injuries or death to officers or victims because of miscommunication or confusion.





"We haven't changed the way we respond, because in life and death situations you must respond always prepared, good or bad," McCarthy said. "But we want to be really careful it is not a prank and this isn't the home of some unsuspecting individual. We have to be extra vigilant because this is occurring."


On Monday, an LAPD lieutenant warned over the police radio that a domestic violence and possible shooting call at the Hollywood Hills home of Brown could be swatting.


The initial report came to the LAPD via TTY device, which is typically used by the deaf to type text over the telephone. The device has been used in other false calls alleging violent crimes at the homes of area celebrities.


Brown was not home at the time of the incident, which was reported shortly before 5 p.m., but people employed by the singer were at the home when the LAPD showed up, police said. Brown's parents arrived at the residence shortly after police, LAPD officials said.


The incident is the third in a series of pranks targeting celebrities.


In early October, Los Angeles police dispatched several units and tactical officers to Kutcher's home on Arrowhead Drive after they received a report through a TTY device from a woman who said she was hiding in a closet because there was a man with a gun inside the residence, according to sources familiar with the case.


Police responded and briefly held workers at gunpoint at the home before contacting the actor and determining it was a hoax.


A week later, Los Angeles County sheriff's deputies received a report claiming a gunman had fired shots at Bieber's house and was threatening to harm police when they showed up. The message also was received through a TTY device and sheriff's officials later determined that the call was a hoax and that the pop star was away on tour at the time of the incident.


The LAPD tracked the calls and in December arrested a 12-year-old boy who was charged last week by the Los Angeles County district attorney's office with three counts of making false threats stemming from phony police incidents at the Kutcher and Bieber residences.


But the swatting calls apparently began anew last week.


A Beverly Hills police SWAT team surrounded actor Tom Cruise's home Thursday after a report of shots fired. The next day, Los Angeles County sheriff's deputies responded to a call of a possible shooting at the former Malibu residence of the Kardashian-Jenner family.


Sheriff's spokesman Steve Whitmore said that while the department has not definitively determined that the incident, described as a shooting, involved swatting, it was "a definite possibility." He said the Sheriff's Department is also adjusting its response to reflect such prank calls.


"As we become more advanced, the Sheriff's Department is responding appropriately to each occurrence," Whitmore said. "We are getting better about identifying what is real and what is not."


As swatting incidents continue, Lt. Andrew Neiman said the LAPD is looking for ways to increase the consequences for those behind a prank that could be deadly and that is costly for the city while also diverting police and firefighters from real emergencies.


The department has approached the city attorney about pursuing civil remedies against the pranksters to recover the cost of the large responses. Chief Charlie Beck said the LAPD is also hoping California, as Michigan did last year, will tighten the law and penalties for such pranks.


"If there is anything that comes out of the interest in this as new technology emerges and abuse of new technology occurs, then we have to address that with new laws," Beck said.


"God forbid somebody gets severely injured or killed in an incident like this. I don't doubt the felony murder would apply. We would certainly try to do that."


Sheriff Lee Baca and a state senator are seeking to increase the penalties for swatting.


Under a proposed swatting bill by Sen. Ted Lieu (D-Torrance), if convicted the person making the false emergency report would be held liable for all costs associated with the response by law enforcement.


Lieu's bill also would make it easier to charge the perpetrator with a felony when someone gets hurt as a result of the prank call. Prosecutors would no longer have to show that the person knew injury or death would occur as a result of the false report. Those convicted could get as many as three years in prison if someone is injured.

In quirk, some California residents have two state senators, others none









SACRAMENTO — Many state senators will serve constituents outside their official districts for the next two years to address a quirk caused by the redrawing of political boundaries in 2011.


When the legislative district maps were remade, some new districts overlapped old ones. Voters in only half of the 40 state Senate districts chose representatives last year. Some communities in the old districts were moved into new ones that will not have elections until 2014.


That has left nearly 4 million Californians without an elected representative in the Senate for the next two years, while others temporarily have two senators.





"That happens during every redistricting. It can't be helped," said Peter Yao, former chairman of the Citizens Redistricting Commission, created by voters to redraw legislative boundaries every 10 years. "It has happened more this time around because we dramatically moved the district lines."


Lawmakers last week approved a plan to have many senators temporarily provide constituent services for voters who would otherwise be unrepresented in California's upper house.


"The idea is to make sure that everyone has a place to turn for issues and that everyone has a voice even though you have this anomaly," said Mark Hedlund, a spokesman for Senate leader Darrell Steinberg (D-Sacramento).


The problem does not exist for the Assembly because all 80 districts are on the ballot every two years.


State Sen. Lou Correa (D-Santa Ana) of the 34th Senate District is looking forward to temporarily representing 1.3 million people, about 300,000 more than usual, as he takes on new areas including parts of Long Beach, Huntington Beach, Los Alamitos and Seal Beach.


"It's going to be a challenge, but I really enjoy reaching out to constituents," Correa said Monday. "I've never represented the beach before, so the first thing I am doing is getting acquainted with the California Coastal Commission."


Correa said he is getting two additional staffers to help serve the new areas.


Sen. Ted Lieu (D-Torrance) of the 28th state Senate District will serve as caretaker for parts of Santa Monica, Rancho Palos Verdes, Brentwood, West Hollywood and Westwood that would otherwise go two years without a representative.


He has begun attending community events in the new areas, which have a population of 387,000.


"I do wish I could double my staff, but everybody's going to have to work harder," Lieu said.


In the San Fernando Valley, Sen. Alex Padilla (D-Pacoima) of the 20th Senate District will serve parts of Studio City and Sherman Oaks.


Sen. Bill Emmerson (R-Hemet) of the 23rd Senate District will temporarily represent parts of Palm Springs, La Quinta and Idyllwild.


Steinberg, the 6th District senator, will temporarily serve 267,000 more residents in areas including parts of Elk Grove and West Sacramento.

Gun control draws vigorous debate across California









From shooting ranges to churches, gun control was the subject of vigorous debate over the weekend at various venues across California.


In Sacramento, hundreds rallied in front of the Capitol on Saturday to protest efforts to restrict gun ownership. President Obama has called for an assault weapons ban, a universal background check system for every gun sale and a ban on high-capacity ammunition magazines.


At the Los Angeles Gun Club, range master Joseph Im said the downtown facility had seen an uptick in its ammunition sales since the Sandy Hook shooting and the renewed debate over gun control.





Thomas Brambila, 38, and Tamara Vravis, 43, had come to the range on a first date. Brambila said he had grown up target shooting, although he does not own a gun now because he has young children at home. He called Obama's gun control proposal "misguided."


Vravis said she grew up on a ranch in Minnesota, where guns were common. She agreed with Brambila.


"I think if you really want to get a gun, you can get a gun. It's going to hurt the law-abiding citizens," she said of the move to tighten gun laws.


While some people were celebrating their love of guns, others held events to draw attention to gun violence. A network of churches around the country planned a Gun Violence Prevention Sabbath in response to the Sandy Hook shooting, with services centering on community members who have lost family members to gun violence.


The City of Refuge Church in Gardena held special services Sunday to call for efforts to crack down on gun violence. Hollywood Adventist Church held a smaller gathering of a few dozen Saturday.


Carmen Taylor Jones and Darryl Jones spoke about their 15-year-old daughter, Breon Taylor, who was killed five years ago Saturday when two young men shot through a window into the Lakewood Masonic Lodge, where Breon was one of several hundred young people attending a birthday party. Breon and a 17-year-old boy were killed.


It was the day before Taylor Jones' 45th birthday.


"At that moment, in the twinkling of an eye, everyone's lives, some of their destinies were interrupted," Taylor Jones said.


The gunmen who shot into the party, 16 and 19 at the time, were eventually sentenced to a combined 400 years in prison.


Taylor Jones, who grew up in Watts, said she sees memorials for other young people who were gunned down and worries about the safety of her 15-year-old son.


"When he's with me in South Los Angeles, I almost feel like he's a target, like he has a mark on him," she said.


Taylor Jones said she believes the Sandy Hook massacre got people's attention in a way that individual tragedies like her daughter's death couldn't. She called Obama's gun control proposal "a step in the right direction."


"It's just time for us to have some very serious conversations," she said.


The Sacramento protest was one of dozens held at state capitals nationwide as politicians push new gun laws.


They keep adding more and more laws," said Wes Holst, who hosts a radio show about guns in Santa Cruz. "More laws don't prevent crime."


Some people waved flags or hoisted signs saying "Hands off my guns" and "Gun laws don't stop criminals, bullets do," and many spoke fearfully of restrictions they say would leave them defenseless against criminals or even a government they view with suspicion.


California has some of the toughest gun laws in the country, and there were no firearms to be seen at Saturday's rally. A few people wore empty holsters.


Daniel Silverman, an information technology consultant who lives in Tracy, Calif., said he organized the Sacramento event as part of a grass-roots campaign called Guns Across America. He said the rally was not connected to Gun Appreciation Day, which was started by a Republican consulting firm in Washington.


He said politicians have unfairly singled out firearms as the cause of violence. A gun, he said, is only "a piece of plastic, aluminum and steel that does no harm in the hands of good men and women."

Costa Mesa confronts homelessness head-on









The police officers made their way though the Costa Mesa park known as "ground zero," the crowded hub for the city's homeless, handing out fliers and encouraging people to get on a bus that would take them out of town.


Like other cities, Costa Mesa has had a tenuous relationship with its homeless, and many would just as soon they all simply leave. But efforts on this crisp afternoon had a different motivation: They were nudging them to seek shelter from the near-freezing nights that had gripped the area and board a shuttle to the Santa Ana armory.


In the morning, they promised, the bus would bring them back, bright and early.





"There has been a shift," said Becks Heyhoe, director of the Churches Consortium, a collective effort of about a dozen churches in town. "The city has shown — really, for the first time in its history — they are willing to address homelessness in Costa Mesa. This is really the first time the city has taken a stab at it."


A back-and-forth relationship with the homeless has long been the blueprint in a city that is defined by the high-end elegance of South Coast Plaza at one end and the clusters of homeless dozing under the shade trees and hanging around Lions Park at the other.


But the response to the deaths of two homeless people last week as temperatures dropped down into the 30s highlighted an evolution of the city's outlook, as city services and local charities were kicked into action.


Those aiding the homeless have long been the target of scorn by those wanting to rid the city of the people who drift through the old city core and sleep in the park. The bounty of services there was seen as magnets for transients. A few months ago, the now-former mayor pushed for decades-old service providers — including a clinic and a soup kitchen — to be investigated. The problem might be cured, he said, "if we managed to put the soup kitchen out of business."


But the recent deaths have expedited ongoing efforts to improve services and care for a segment of the community considered vulnerable. Patrols were stepped up and volunteers handed out blankets. One woman who lived in her car and who suffered from a chronic illness was taken to a motel to spend the night.


"We don't want any more people dying on us," said Rick Francis, assistant chief executive of Costa Mesa. "That's the bottom line."


Two years ago, when tensions over the homeless population reached a peak, the city formed a task force to confront the issue. Residents had grown frustrated by the homeless taking over Lions Park, and complained about finding abandoned needles and drunk people in the middle of the day. "It's like everything came to a head," said Muriel Ullman, a longtime city employee who now works as a consultant on homeless issues.


At that point, many held to the theory that the homeless numbers were growing at such a swift clip that there was no hope to manage, said Edward J. Clarke, a professor of sociology at Vanguard University in Costa Mesa, who had led a multi-year count of the homeless population.


But his count showed that those apprehensions were unfounded. He documented about 120 homeless people with ties to Costa Mesa, with a few dozen others who came from outside the city — a figure that remained close to the same over five years. He said many came from colder climates — "the kind of places where homeless people die in the winter — and others just wandered between cities in Orange County, "where you can easily cross the border by crossing the street."


The task force's recommendations, which came out last year, focused on streamlining services and tailoring them to the needs of that community, in particular those who are Costa Mesa natives.


The churches, Heyhoe said, were also prompted to do some soul-searching about services that were found to be redundant or simply ineffective: "Were we doing it because it made us feel good or because it was really meeting a need?"


Based on task force recommendations, a picnic shelter in Lions Park that was used to hand out meals — a place that had become a homeless hangout — was demolished, and bikes are now required to be secured to racks instead of strewn about the park.


At the same time, the city hired a social worker, who worked to help people find housing or enroll in substance abuse programs. The Churches Consortium has also built a storage facility for the homeless to tuck away their possessions — backpacks, bags and carts — and come by weekly to do laundry and take a shower. Heyhoe said more than 150 people used the service last year, freeing them to have a chance to go to job interviews or enter detox programs.


Heyhoe said the system citywide has become "a lot more strategic, a lot more coordinated and, I'd argue, a lot more effective." Ullman echoed that, saying that various forces — the city, charities and churches — seem to now be pushing in the same direction. "It's kind of like we're all a team now."


One of those most recent projects has been testing out a shuttle service, carrying people to the Santa Ana armory each night.


Heyhoe met up with Costa Mesa police officers one afternoon last week, starting at the city library at the center of Lions Park and fanning out into the streets.


They met resistance as they handed out fliers. One couple was suspicious, taking it as an attempt to run them out of Costa Mesa. Others thought the armory was too sketchy — or "where all the jailbirds are," one woman told Heyhoe. A man who had made the trek to the Santa Ana armory before refused to return: "That's the worst place I've ever been."


Rose Ouellette, 44, was hanging out at the Someone Cares soup kitchen and was receptive. She said she's noticed a change for the better in services, especially the storage facility known as a "check-in center."


"It has helped me out a lot," she said, grateful for the lighter load. "You don't have to carry your stuff."


But Ouellette, who said she has lived in Costa Mesa for 15 years, had enough of the outsiders coming in and leaving rubbish in the park. "It's disgusting," she said.


As the time approached for the bus to make its pickup, a small group had gathered in the church parking lot.


Trevor Martinez was one of them. "If they've got transportation over there, and I can stay out of the cold, that sounds like a good idea," said Martinez, who's been on the streets since May. "I can't walk that far."


One man, who took the ride to the armory the day before, was back again. "It's all right," he shrugged. "It wasn't cold."


When the bus pulled up, only four people climbed aboard. But Heyhoe was optimistic. It was one more than the day before.

West L.A. teacher's class act earns a Milken award









Jackie Bonilla knew there would be a special presentation at Clover Avenue Elementary in West Los Angeles on Friday morning.


She didn't know it would be for her.


The second-grade teacher was surprised by the announcement of the Milken Educator Award, an honor given to 40 teachers nationwide this year. Each recipient gets a $25,000 prize, no strings attached.





The honor is given by the Milken Family Foundation, which created the award in 1987 to motivate gifted teachers in a field in which financial gifts are rare.


Bonilla, who was awarded the prize by foundation Chairman Lowell Milken at an assembly also attended by L.A. Unified Supt. John Deasy and State Supt. of Public Instruction Tom Torlakson, is a Cal Poly San Luis Obispo graduate. She was the only California teacher so recognized this year.


Bonilla thought the event she would be attending was organized to recognize her school's new status as a National Blue Ribbon School. Then Milken took the microphone and asked the assembled students, "Have you seen a teacher get an A?" He then asked her to rise.


Bonilla, visibly moved, paused to compose herself before thanking her principal and colleagues and accepting the award.


"I am extremely honored and humbled," she said. "Teaching is truly is my passion; I don't look at it as a job."


With the help of each state's board of education, the awards are made based on a confidential process that takes into account teachers' methods, leadership outside the classroom and their students' test scores.


Bonilla, who switched to second grade this year, is rated among the "most effective" of district teachers in math and English, according to The Times' value-added analysis. During the 2011-12 school year, 87% of her third-grade students scored proficient or above in English language arts on the California Standards Test.


She now joins "a great network of teachers" who have won the award, said Shannon Garrison, a fourth-grade teacher at Solano Elementary who received the award in 2008.


The Milken Foundation nominated Garrison for her position on the National Assessment Governing Board — the committee that sets policy for the National Assessment of Educational Progress, or NAEP, test — and she carried the Olympic torch in Edinburgh, Scotland, before the 2012 Summer Olympics.


"That award changed my life. It created an immediate support system of people that think you're going to do great things," Garrison said.


Back in Bonilla's colorful classroom, each of her students recited Martin Luther King Jr.'s "I have a Dream" speech.


"She makes math fun," said one student. "And she's the only teacher to laugh at all our jokes."

EPA proposes compromise on Navajo Generating Station's emissions









The Environmental Protection Agency is proposing regulations to reduce emissions from the massive Navajo Generating Station by as much as 84%, in a compromise that would give the plant's operators more time to install scrubbers and would ease the economic impact on two Native American tribes.


Situated in northern Arizona, less than 20 miles from the Grand Canyon, the generating station is the source of haze viewed by tourists at nearly a dozen parks and wilderness areas in the Southwest.


The EPA's proposed rules would allow the 2,250-megawatt plant until 2023 to install pollution controls to meet emissions standards mandated by a Regional Haze Rule. The plant is one of the largest sources of harmful nitrogen oxide emissions in the country, but the agency is proposing to add five years to the compliance date in response to concerns by Navajo and Hopi tribes, EPA Regional Administrator Jared Blumenfeld said.





"It's a deserving compromise, given the real economic threats that face the tribal nations," Blumenfeld said, calling the issue the most complicated he'd ever dealt with. "We wanted to provide enough time to work out the economics so that the facility remains open."


The coal-fired power plant is on land leased from the Navajo Reservation and burns coal mined on both the Navajo and Hopi reservations. The equipment required to bring the plant into emissions compliance would cost an estimated $500 million, and the tribes and a number of groups argued that the economic burden might cause the operators to close the facility, which employs hundreds of tribal members.


The generating station is co-owned by several entities, including the Los Angeles Department of Water and Power.


Blumenfeld said the EPA proposed extending the compliance period also in recognition that the plant's operators had previously installed emission-reducing equipment. When the plant is in compliance, its emissions will total no more than 28,500 tons per year.


"For 90% of the year, the Grand Canyon's air quality is impaired by a veil of pollution haze that reduces the pristine natural visual range by an average of more than 30%," Blumenfeld said in a statement.


National parks and wilderness areas are required to maintain Class I airsheds — the highest level of clear skies. In addition to the Grand Canyon, nearby parks include Zion, Bryce Canyon, Mesa Verde, Arches and Canyonlands.


The plant also provides the power that drives the Central Arizona Project, an expansive aqueduct system that provides water to much of Arizona. State agencies had petitioned the EPA to consider the proposed rules' effect on the cost of water delivery.


The proposed regulations are open to a 90-day comment period.

Buddhist temples push to get storm-relief money moving









When the Venerable Thich Quang Thanh asked members of his Buddhist temple in Santa Ana to donate money to help victims of Superstorm Sandy in New York, he was encouraged when the charity dollars began to swell.


But his spirit faltered when he found out that a chunk of the money — a pair of checks totaling $27,000 — made it only as far as neighboring Westminster, where the funds were deposited into a local bank account.


Thich Quang Thanh, who heads the influential Bao Quang Temple, said the checks were made out to the Mayor's Fund to Advance NY City and should have been delivered to New York Mayor Michael R. Bloomberg by now.





The abbot said he discovered that the checks had been deposited at a Wells Fargo branch in Westminster only after reviewing the temple's latest bank statement.


"We had requested it be sent as soon as possible. Many months have passed since the hurricane," he said.


"I cannot accept the situation," added the Venerable Thich Chon Thanh, of Lien Hoa temple in Garden Grove, who also collected funds.


He and Thich Quang Thanh wrote to Orange County Supervisor Janet Nguyen, who in turn sent a letter to the district attorney Wednesday, pushing for an investigation.


"It's really sad and unfortunate. They put their name and their credibility out there to raise money, and now this," Nguyen said.


"When people are generous, we need to follow up with them," the supervisor said. "We want to know three things: How the check was cashed, where the money is now and how will it be delivered."


Susan Kang Schroeder, spokeswoman for Orange County Dist. Atty. Tony Rackauckas, said that she is aware of the situation and that prosecutors will review the complaint and take "any appropriate action that's necessary."


The checks — one for $20,000, the other for $7,000 — were handled by the Vietnamese Interfaith Council, which was to make sure the money got to New York.


Thich Quang Thanh said a representative of the interfaith council told him that the money was safe and would be delivered after the Lunar New Year festivities in Little Saigon, the Vietnamese district that sprawls across central Orange County.


Among the festivities that highlight the Feb. 10 celebrations is the annual Tet parade, but this year organizers are working to raise money for the event, with more than $30,000 of the $60,000 needed already collected, according to Nghia X. Nguyen, vice chairman of the council.


The representative with whom Thich Quang Thanh said he spoke with is Nguyen, who heads the parade fundraising.


"What does the parade have to do with money for hurricane victims?" asked Thich Chon Thanh, the Garden Grove abbot.


During a news conference Wednesday night in Little Saigon, members of the Vietnamese Interfaith Council said it appears that no one endorsed the checks and that each contains the words "lack of endorsement" on the back.


Council members said it is their practice to quickly deposit checks such as the donations from the Buddhist temple and that a detailed ledger is kept of all donations.


"We cannot keep it at home," said Hoang Vu, who heads the interfaith council's finance committee. "We have to keep it in the bank."


Council members said they have raised nearly $160,000 from various sources for storm relief and have an appointment to deliver the money in New York on Feb. 22. The reason they're waiting that long, Nghia Nguyen said, is so they'll have "a chance to visit with storm victims who are suffering."


"Each donation carries sentiment, compassion," said Bishop Van Thanh Tran, council chairman. "We value that... We have not taken one dime."

With laughter and tears, fans bid farewell to Huell Howser









Everyone thought they knew what Huell Howser would have said if he'd been standing outside Griffith Observatory just before sunset Tuesday afternoon.


If he'd climbed the observatory steps in a short-sleeved button down, khakis and work boots and taken in the hundreds who had come to celebrate him, a crowd stretching in glorious honeyed light beyond the Astronomers Monument and into the overflowing parking lot.


If he'd known that his fans had started arriving about 9 a.m. for a public memorial due to start at 3:30 p.m., that among them were teenagers and nonagenarians, some of whom had driven for hours — from the far-flung California cities and small towns he'd visited, from the mountains and deserts he loved.





If he had seen Lynne Green, 90, of Woodland Hills holding court in high style in the first row of folding white seats, wearing a jaunty red hat decorated with a red feather and telling everyone she met about how, after she'd signed up at 80 for Buddy Powell's commercial acting class for seniors, Howser came to do a show on the class and "made me one of his featured speakers."


It was so easy to picture Howser there, plunging happily into that crowd, microphone in hand, stopping to squeeze the shoulders of people bundled in winter coats, scarves wrapped around their heads, and warming them up in his Tennessee drawl with a loud "Howdy!" or a "How y'all doin'?"


L.A. City Councilman Tom LaBonge arranged the memorial for Howser, who died last week at 67, and who became a California household name in three decades of exploring the state's people and places in his homespun television shows.


Similarly exuberant and smitten with the state, LaBonge and Howser were longtime friends. But even those in the gathering who knew Howser only from watching TV spoke of him as if he were family. Some teared up as they affectionately swapped stories about him with the strangers they found themselves standing next to in the crowd. They talked about how his shows had sent them out, in search of the obscure monuments and the hole-in-the-wall diners and the odd festivals he'd told them about.


"He always found something cute to say, no matter what. I had a big crush on him," confessed Joy Fisher, 78, of Mid-Wilshire.


Teresa Cerna, 65, of West Hollywood said she had a crush on him too, for "his personality — so warm — and his accent." She said that she'd raced to make it to the observatory from Newport Beach, where she works in a private home as a cook, and that she'd once waited outside Pink's for 2 1/2 hours to get Howser's autograph.


Gloria and Beverly Pink, dressed in pink, took a break from their family's famed 73-year-old hot dog stand to attend, carrying with them the sign for their $5.80 "Huell Dawg" — two hot dogs in one bun, with mustard, chili, cheese and onions. The bright yellow sign, which they pulled off the wall for the occasion, fittingly is in the shape of California.


Howser was so humble, the ladies Pink said, that he wouldn't cut in line when he visited, even though everyone knew who he was and vied to offer him the chance.


Tuesday's gathering featured a lineup of speeches, from the director of the observatory, the executive director of the Los Angeles Conservancy, pop culture historian Charles Phoenix and others. As the sun began sinking just before 5 p.m., an LAPD helicopter circled in a salute.


Then Howser's voice suddenly boomed from the speakers, singing "California, Here I Come." LaBonge asked everyone to sing along, and they did. As the song played again and again, people joined him, singing and dancing on the observatory steps.


It was heartfelt. It was hokey. It felt just right.


Everyone thought they knew what Howser would have said if he'd seen it.


"Oh my gosh!" they could practically hear him. "That's amaaaaaazing!"


And on this day, it would have been an understatement.

SoCal Edison destroyed downed poles before inspection









A state probe into the widespread power outages caused by a furious 2011 windstorm was unable to determine whether toppled utility poles met safety standards because Southern California Edison destroyed most of them before they could be inspected.


The winds that roared through the San Gabriel Valley knocked down hundreds of utility poles, snapped cables and uprooted scores of trees, leaving nearly a quarter of a million Edison customers without power, some for a full week.


In a report released Monday, the California Public Utilities Commission found that at least 21 poles were unstable because of termite destruction, dry rot or other damage before tumbling over in wind gusts of up to 120 mph on Nov. 30 and Dec. 1, 2011.





But more than 75% of the 248 Edison poles that were knocked down in the storm were destroyed by the utility before they could be inspected, a violation of commission rules.


"At the onset of [power] restoration efforts, preservation of failed poles was not made a priority by Southern California Edison," the report says.


Of the 248 poles that failed, partial segments of only about 60 poles were collected and delivered for analysis by commission engineers — the remaining poles were "discarded by SCE staff," according to the report.


Efforts to reconstruct downed poles, many of them sliced into segments smaller than 10 inches, "were immensely hindered by the nature of SCE's collection and cataloging methodology," investigators reported.


Edison workers scattered small pole segments in various collection bins, "making it nearly impossible to determine which failed pole they belonged to," according to investigators.


A spokesman for the utility declined to comment on the report, saying the utility was in the process of formulating a statement.


Commission investigators also found that at least 17 wire pole support systems did not meet safety standards.


The report calls on Edison to update its emergency response procedures and test them on a yearly basis.


Officials will consider formal enforcement actions, including financial penalties, if Edison does not comply.


In a statement Monday, U.S. Rep. Judy Chu (D-Monterey Park) — who represents Pasadena, South Pasadena, San Marino and other San Gabriel Valley cities — called for "immediate action" to ensure the issues raised in the report would not recur.


"This report confirms that by following such regulations and by asking for mutual assistance, power could have been restored more quickly," Chu said.


Former Assemblyman Anthony Portantino, who until recently represented part of the affected area, said the report "confirms what everyone who lived through the windstorm knew from personal experience, that Edison was not prepared and public safety and consumers suffered as a result."


State Sen. Carol Liu (D-La Cañada Flintridge) said the report raises fears that Edison equipment might sustain similar damage in future disasters.


"I am concerned that service and safety doesn't seem to be their priority," said Liu, who is married to California Public Utilities Commission President Michael Peevey.


The report comes less than a year after an Edison-commission study determined the utility had inadequate plans in place for emergencies and communicating with the public. The study, by Maryland-based Davies Consulting, also said the utility could have shortened power restoration time by one day or more by doing a better job of tracking and preparing for bad weather.


At the same time, the consultant commended Edison for having adequate staffing and managing a response that left no workers or customers injured.

To lock classroom doors or not?









Behind a locked classroom door, a Los Angeles third-grade teacher purportedly committed lewd acts against students. The charges spurred demands for classrooms to remain open during the school day.


But after the shooting deaths of 20 first-graders in Connecticut last month, calls were made to keep classrooms locked.


The intent of both efforts is to keep students safe. But as school districts nationwide examine their security measures following the Newtown, Conn., massacre, the question of locked versus unlocked classroom doors is in debate. Should teachers and administrators use their secured doors as a shield from an outside danger? Or does a locked door conceal a potential danger inside?





The answers differ. Some schools, such as the 14 operated by local charter group PUC Schools, are required to keep doors open. Others, including the campuses in the Martinez Unified School District in Contra Costa County, require classrooms to be secured at all times. The Los Angeles Unified School District, like many others, leaves it up to administrators and instructors to decide, and the decision can vary from teacher to teacher.


Such security concerns come as educators and experts say a key piece of education reform is to allow teachers and administrators to drop in and out of classrooms to observe colleagues at work. Keeping doors open minimizes the disruption.


There is no easy solution, say teachers, parents and administrators.


On Thursday, a 16-year-old student wielding a 12-gauge shotgun burst into an unlocked classroom at Taft Union High School near Bakersfield and shot a fellow student in the chest and wounded a teacher.


Desiree Manuel, principal at Huerta Elementary School in Los Angeles, says a secured door may have at least slowed down the gunman.


"If a person was on campus and they were looking to get in a class to do damage, if they can't open the door immediately, they might keep going until they find an unlocked door," she said. "If the doors are locked, the hope is that they would keep checking, which would buy us more time."


Manuel has a policy of keeping classrooms locked. It gives peace of mind to the staff members who deal with significant foot traffic in front of the campus south of downtown, she said.


Manuel doesn't think she's at a disadvantage in terms of noticing signs of improper behavior by teachers or students. She regularly visits teachers, has a master key and can see into classrooms through window blinds.


"Locked doors just help everyone feel safer on campus," Manuel said. "It is just easier to keep the doors locked because of the community that we're in."


At the Partnership for Los Angeles Schools, a nonprofit under the control of Mayor Antonio Villaraigosa, part of the teaching philosophy is to be transparent and open. Teachers are encouraged to keep doors open during instruction, although there is no mandate.


"We so much subscribe to the notion of having administrators and peer observers in the classrooms all the time," said Patrick Sinclair, a spokesman for the group that operates 15 campuses, including Huerta. "We can't keep the doors locked because we have so many people coming and going. That's part of the model."


Locked doors could hinder that approach while not truly guarding against a tragedy like the one at Sandy Hook Elementary School in Newtown, Sinclair said. There, a gunman shot and killed 26 people, including 20 children and six adults, before turning the gun on himself.


"The school didn't let him in. He shot his way in. There may be nothing you can do short of turning your school into a windowless fortress," he said.


Keeping doors open, Sinclair said, also helps safeguard students from what reportedly occurred at Miramonte Elementary School in the Florence-Firestone area. Third-grade teacher Mark Berndt was charged last year with 23 counts of lewd conduct for allegedly spoon-feeding his semen to students, among other acts. He has pleaded not guilty and remains in jail on $23-million bail.


Parents have mixed reactions.


At the schools his children attend in Burbank, parent David Dobson said, "Ninety percent of the doors are unlocked."


"One teacher at Disney Elementary locks her door," he said, quickly adding, "but we know her very well."

Henry's Tacos stands down









Janis Hood got her start at Henry's Tacos when she was 10.


Her mother allowed her to fasten caps on the hot sauce and serve RC Cola to customers.


Through 51 years, the family business served ground beef tacos and burritos to customers. But on Saturday, the Studio City neighborhood treasure — a favorite of actor Elijah Wood and comedian George Lopez — closed its doors.





The shutting of Henry's Tacos, named for Hood's grandfather, Henry Comstock, came after a yearlong saga with the landlord that Hood said began when she applied for a historic designation. She said the application sparked conflict, and the landlord refused to renew her lease.


"It's a very emotional day for me," Hood said Saturday.


In recent weeks, news of the closure prompted thousands of fans to sign an online petition to save the restaurant and inspired a Twitter hashtag (#SaveHenrysTacos).


At one point, a financial consultant and a TV writer were in talks to purchase the restaurant to keep it open. "It all just took us back to our childhood," said Matt Pyken, a Studio City TV writer who grew up eating at the stand, explaining why he sought to buy it with his former middle-school buddy. "We wanted it to be the same place."


But in the end, Hood decided to work with longtime employee Omar Vega, who wants to relocate the shop but keep the name. Hood said she plans to eventually sell the business to Vega. A preservation group has offered to store the stand's signage, she said.


On Saturday, customers formed a line down the sidewalk for a last meal, and Hood said the stand would keep serving them until the food ran out. Cathy McCroskey, a longtime customer, posed for a picture in front of the stand and pantomimed wiping away a tear. "This is a neighborhood icon," she said.


McCroskey and her husband, Steve, both 55, have lived in the Tujunga Village area since the late 1980s and came to pay one last visit to the stand they'd enjoyed for years. They took photos and, of course, ordered a bean and cheese burrito. They said the stand's Googie-style architectural design and history made it a neighborhood gem.


Near them, a large sheet of paper had been taped to a wall of the stand for people to jot their goodbyes.


"Sacred ground. We have been coming for four generations. It was the first food I ate and my kids ate. It saved my sister ... it was all she would eat when she was sick. Please prevail," wrote Kathryn Vanderveen.


"Henry, please keep the sign and stay in Studio City, we love you," another message said.


Vega, a 21-year veteran of the stand, said he hopes to do just that. He would like to retain the old location's ambience by using the old sign and menu and even hopes to replicate the colorful lettering on the stand's outside wall that spells "Henry's Tacos."


"I hope everything goes well," Vega said.


For Hood, the closure is the end of an era. She said the restaurant is where she grew up and recalled going to elementary school blocks away. After school, she'd walk to the stand to see her mother and linger there.


"A lot of the customers took me under their wing and were helpful to me," she said.


After Hood's mother, LeVonne Eloff, died in 2009 at 82, longtime customers shared stories with Hood, some of which she said she had never known. They told her, for example, that her mother and stepfather had sometimes used the honor system with customers.


Now, Hood said she's acting in the same vein, "paying it forward" by helping Vega get his start running the business, a move she sees as continuing her family's legacy.

Prominent porn producer suing L.A. County over new condom law









One of the nation's most prominent pornography producers is suing Los Angeles County in federal court to overturn a new law requiring actors to wear condoms during filming.


The suit by Vivid Entertainment, filed Friday in U.S. District Court in Los Angeles, says the 1st Amendment's protection of free expression was violated after 57% of L.A. County voters approved the condom-porn measure during the Nov. 6 election.


"The exercise of 1st Amendment freedoms cannot be limited by referendum," the suit said. The ordinance stands "as an unconstitutional prior restraint upon protected expression."





Steven Hirsch, Vivid's founder and co-chief executive officer, said in an interview: "We will fight for our right to express ourselves as we please."


Paul Cambria Jr., the lead attorney on the case, said Measure B infringes upon how directors make films. "Let's assume that we're filming an adult movie and it was taking place in the swashbuckler times. All of a sudden, Captain Jack slips on a condom.


"Obviously, that would basically destroy the movie, because it would be fake. Obviously, people would know that couldn't have happened then," Cambria said.


Supporters of the condom-porn measure say Measure B does not violate the 1st Amendment. They say it is a health and safety measure aimed at protecting porn performers from contracting HIV and other sexually transmitted diseases.


"This is not a free speech issue. This is a workplace safety issue," said Michael Weinstein, president of the AIDS Healthcare Foundation. "If they want to digitally remove a condom" from the final cut of a film, "there's no issue."


Hirsch said such special effects are "cost-prohibitive and it puts me in a place where we're not on a level playing field" with other adult-film performers based outside of the county.


Measure B requires that porn producers purchase public health permits to film in the county, and mandate condom use as a condition of that permit. The ordinance took effect in December, but the county has not decided how to enforce the law.


Hirsch said he wanted to overturn the measure to allow the porn performers and producers to remain in Los Angeles.


California is one of only two states — the other is New Hampshire — where state high courts have prohibited the prosecution of porn producers under anti-prostitution laws. Los Angeles is a world leader in the production of adult films.


"This is where they work, this is where they live, this is where our families are. And there's no reason we should have to move," Hirsch said.


The suit also argues that only the state, rather than the county, has the ability to impose occupational safety and health standards.


Weinstein cited a legal opinion by the state's Division of Occupational Safety and Health in 2011 saying that a municipal government may enact its own public health standards.


Hirsch said that after Measure B went into effect, Vivid suspended filming within Los Angeles County.


County officials did not respond to a request for comment.

Restored funding for prescription drug-monitoring program urged









California Atty. Gen. Kamala D. Harris on Thursday called on Gov. Jerry Brown to restore funding to a prescription drug-monitoring program that health experts say is key to combating drug abuse and overdose deaths in the state.


Harris' appeal to restore funding to CURES, as it is known, follows an article in The Times last month that reported that the system, once heralded as an invaluable tool, had been severely undermined by budget cuts and was not being used to its full potential.


The CURES database contains detailed information on prescription narcotics, including the names of patients, the doctors prescribing the drugs and the pharmacies that dispense them. The system was designed to help physicians detect "doctor-shopping" patients who dupe multiple physicians into prescribing drugs such as OxyContin, Vicodin and Xanax.








Harris' request followed Brown's unveiling of a proposed $97.7-billion budget, which projects a surplus — a feat that has been accomplished only one time in the last decade. With California's fiscal condition improving, Harris said it was up to the state to make sure the money was "spent wisely."


"This includes smart investments that benefit Californians, such as restoring funding for the state's prescription drug-monitoring program," she said in a statement.


Brown's office had no comment.


The governor's budget does increase Harris' Department of Justice general fund allocation by 4.5% to $174.3 million, but it does not earmark money for CURES. Harris could seek legislative authority to spend some of her budget on the program.


"We are going to have a discussion on the funding and where the money will come from," said Lynda Gledhill, a spokeswoman for Harris.


CURES is the nation's oldest and largest prescription drug-monitoring program and once served as a model for other states. Today, it has fallen behind similar programs elsewhere. CURES data could be used to monitor physicians whose prescribing puts patients at risk. But it is not.


The U.S. Centers for Disease Control recommends that states use such data to keep tabs on doctors, and at least half a dozen states do so.


As part of spending cuts aimed at maintaining the state's solvency amid a deep recession, Brown gutted the Bureau of Narcotics Enforcement, which ran CURES, in 2011, shortly after Harris succeeded him as attorney general. Harris kept the program alive with about $400,000 in revenue from the Medical Board of California and other licensing boards. But it is down to one employee and has no enforcement capacity.


State officials have estimated it would cost about $2.8 million to make CURES more accessible and easier to use, and $1.6 million more per year to keep it running. However, officials say the program — with little or no additional financial resources — could now be used to identify potentially rogue doctors.


Bob Pack, an Internet entrepreneur, has advocated using CURES more vigorously to track reckless physicians and pharmacies as well as doctor-shopping patients. He became active on the issue after a driver high on painkillers and alcohol struck and killed his two young children in the Bay Area suburb of Danville in 2003.


Pack, who helped design an online portal to give physicians and pharmacists immediate access to CURES, said he was happy to see Harris ask Brown to restore funds for the program.


"But that's only a request," he said. "No one knows if that's really going to happen. Meanwhile, doctors are continuing to over-prescribe and thousands of Californians are dying from prescription drug overdoses. I hope this … has some bite to it."


An aide to Harris said restoring the CURES program is a high priority.


"She's committed to fixing the database and making it as strong as possible," said Travis LeBlanc, special assistant attorney general. "When we have limited resources and in a budget crunch, we need to focus our resources and use it in smart, efficient ways, and [CURES] is one of those," he said.

Irvine City Council overhauls oversight, spending on Great Park









Capping a raucous eight-hour-plus meeting, the Irvine City Council early Wednesday voted to overhaul the oversight and spending on the beleaguered Orange County Great Park while authorizing an audit of the more than $220 million that so far has been spent on the ambitious project.


A newly elected City Council majority voted 3 to 2 to terminate contracts with two firms that had been paid a combined $1.1 million a year for consulting, lobbying, marketing and public relations. One of those firms — Forde & Mollrich public relations — has been paid $12.4 million since county voters approved the Great Park plan in 2002.


"We need to stop talking about building a Great Park and actually start building a Great Park," council member Jeff Lalloway said.





The council, by the same split vote, also changed the composition of the Great Park's board of directors, shedding four non-elected members and handing control to Irvine's five council members.


The actions mark a significant turning point in the decade-long effort to turn the former El Toro Marine base into a 1,447-acre municipal park with man-made canyons, rivers, forests and gardens that planners hoped would rival New York's Central Park.


The city hoped to finish and maintain the park for years to come with $1.4 billion in state redevelopment funds. But that money vanished last year as part of the cutbacks to deal with California's massive budget deficit.


"We've gone through $220 million, but where has it gone?" council member Christina Shea said of the project's initial funding from developers in exchange for the right to build around the site. "The fact of the matter is the money is almost gone. It can't be business as usual."


The council majority said the changes will bring accountability and efficiencies to a project that critics say has been larded with wasteful spending and no-bid contracts. For all that has been spent, only about 200 acres of the park has been developed and half of that is leased to farmers.


But council members Larry Agran and Beth Krom, who have steered the course of the project since its inception, voted against reconfiguring the Great Park's board of directors and canceling the contracts with the two firms.


Krom has called the move a "witch hunt" against her and Agran. Feuding between liberal and conservative factions on the council has long shaped Irvine politics.


"This is a power play," she said. "There's a new sheriff in town."


The council meeting stretched long into the night, with the final vote coming Wednesday at 1:34 a.m. Tensions were high in the packed chambers with cheering, clapping and heckling coming from the crowd.


At one point council member Lalloway lamented that he "couldn't hear himself think."


During public comments, newly elected Orange County Supervisor Todd Spitzer chastised the council for "fighting like schoolchildren." Earlier this week he said that if the Irvine's new council majority can't make progress on the Great Park, he would seek a ballot initiative to have the county take over.


And Spitzer angrily told Agran that his stewardship of the project had been a failure.


"You know what?" he said. "It's their vision now. You're in the minority."

Yosemite plan calls for more campsites and parking spaces









Yosemite Valley would have more camp sites and parking spaces — and the number of daily visitors would not be reduced — under a National Park Service plan intended to ease congestion in one of the country's most scenic spots.


The proposal is the agency's third attempt to produce a legally acceptable management plan for the Merced River and the ever popular valley that it flows through. Environmental groups have twice sued the agency, winning court orders that compelled the park service to draw up new blueprints.


The latest effort, a lengthy draft document released Tuesday, navigates a middle course. The agency's preferred alternative would restore 203 acres along the river, change traffic circulation and parking, and eliminate an ice skating rink, commercial horseback riding, hotel swimming pools and raft and bicycle rentals.





But the plan steers clear of the politically sensitive issue of reducing the number of visitors to the valley, which on a busy summer day can be packed with nearly 20,000 people.


Kathleen Morse, chief of planning for Yosemite National Park, said the proposal tries to give the public what it wants. "The feedback they gave us was consistent with what we ended up with in the preferred alternative: We want to be able to come to Yosemite. We want to have our cars. We hate the traffic. We would like you to do something about congestion and we want more camping."


Park planners tried to figure out how best to use the limited land base of the valley, which is 1 mile wide and 7 miles long. They decided some commercial activities could go, including the pools, skating rink and other activities.


A pedestrian underpass would be built to ease traffic on a busy road near Yosemite Lodge. Unofficial roadside parking would be eliminated. A new remote parking lot would be built at El Portal just outside the park and a 100-car dirt lot would be opened for overflow traffic during peak visitor days, increasing parking in the valley by 5%. Both lots would be served by shuttles.


No new construction would be allowed within 150 feet of the Merced River, eroded riverbanks would be repaired and vulnerable areas would be off limits to visitors. Some informal trails in meadows would also be removed. Trails and boardwalks at Bridalveil Fall would be redesigned.


The park service proposes adding 174 camping sites in the valley and replacing some tent cabins in Curry Village with year-round cabins. Some aging, employee housing would be replaced with new buildings.


Representatives of the two small environmental groups that have sued the service over previous management plans said they haven't had time to thoroughly study the lengthy new document.


John Brady, chairman of Mariposans for the Environment and Responsible Government, said that while he was not happy with the park's preferred alternative, the draft was an improvement over previous plans.


"I had a relatively positive reaction to it," Brady said. "I think the park service did a good job."


Greg Adair, director of Friends of Yosemite Valley, was less enthusiastic.


"The plan shouldn't be fundamentally about a tweak here and a nip and tuck there about infrastructure and visitor services," Adair said. "We would like to see them do a plan that makes the connection between the visitor experience and the preservation of the natural environment: That essentially solves the problem of how many people can optimally experience Yosemite at its best."


The draft will be open to 90 days of public comment, after which the park service will issue a final decision.

California schools flunk education group's ratings









California is sorely lacking when it comes to school reform, failing to adopt policies to limit teacher tenure and use student test scores in teacher evaluations, according to a rating of states issued Monday by a high-profile education advocacy group.


California received an overall grade of F, ranking 41st nationally, from StudentsFirst, a Sacramento-based group run by Michelle Rhee, the former schools chancellor in Washington, D.C., whose outspoken views have polarized those who share her focus on improving the nation's schools.


Her group's "report card" concentrates "singularly on the education policies in place in each of our states," Rhee said in a statement. "And when we look solely at policy, it's clear that we have a long way to go toward improving our education system in America."








Critics said the ratings say more about Rhee's views than about the state of the nation's schools.


Eleven states received failing grades. California received its only high mark for being the birthplace of "parent trigger" laws, which allow parents, by petition, to replace the staff of a low-performing school or turn over the campus to an independently operated charter.


California's schools would benefit from a statewide teacher and principal evaluation system that incorporates student achievement as a significant factor, the report said.


Such value-added formulas measure a teacher's effect on a student's learning through standardized test scores, taking into account a student's past performance and such factors as race or poverty. Some experts and teacher unions are skeptical of the method, and those critics have had allies in Gov. Jerry Brown and state Supt. of Public Instruction Tom Torlakson.


The California Department of Education had little use for Rhee's rating, with Deputy Supt. Richard Zeiger telling the New York Times that the F grade was a "badge of honor."


The department did not back down when the remark sparked some criticism.


"We're quite happy that California is moving in the opposite direction," said spokesman Paul Hefner. "We think that our schools are making incredible progress, given the enormous strains schools have been under in recent years."


Rhee's top-rated states are Louisiana and Florida; each earned a B-. No state earned an A.


Louisiana has been notable for converting many campuses to non-union charter schools. The state also allows lower-income students or those at poorly performing schools to receive public funds for private school. Florida requires 50% of a teacher's evaluation to be based on student performance. Parents are notified when children are placed with a teacher designated as unsatisfactory, the report said.


Rhee's system gives credit for aggressive state intervention as opposed to local control. Montana was among states receiving an F, in part for asserting "no authority to intervene when schools and districts are not meeting expectations."


The Rhee system gives no direct credit for actual student achievement or the level of spending on schools. Massachusetts, which is frequently lauded in both areas, received a D+ from Rhee's group.


Rhee rose to prominence as the head of schools in the District of Columbia, where she pressured educators to improve student achievement and fired many of them.

From gang member to team player









SAN FRANCISCO — Luis Aroche learned about violence at Leonard R. Flynn Elementary School, across from the projects where his friend Carl lived.


He remembers sitting down at his desk and seeing his teacher, Mrs. Foster, in tears. His class had just finished the Pledge of Allegiance.


"Carl was playing on the swings and got shot," Aroche said. "And died. Kindergarten. He got found laying in a pool of blood in the park," Aroche paused. Swallowed. Started up again. "He was my desk buddy. He would go with me to the bathroom. And now, Carl wasn't there.





"That was my first experience of loss. And I didn't understand it. To this day, I don't understand it."


Aroche since has become something of an expert on violence — as victim, perpetrator and now as part of a hoped-for solution. Last year, San Francisco Dist. Atty. George Gascon hired the former gang member to be his office's first "alternative sentencing planner," part of an effort to keep offenders from ending up back behind bars.


The position, criminal justice experts say, has no equivalent in any prosecutor's office in the country.


And Aroche is as singular as his job. An Aztec skull tattoo stretches down his right forearm to his hand, its grimace partly wiped away by laser removal. The day his juvenile record was sealed, he says, was the happiest of his life.


Today, he helps prosecutors figure out who among San Francisco's low-level offenders deserves a jail cell and who deserves a second chance.


He knows a lot about both.

If you were Aroche, 12 years old and living in the Mission District in 1990 — when gangs and crack cocaine meant funerals were as commonplace as quinceañeras — you got a tattoo, cut school and drank beer. You thought a stint in Pelican Bay State Prison was like going off to "Stanford or Yale." You practiced how to sit and talk and smoke like the toughest prisoners.


"We would learn how to iron our clothes using a comb, 'cause that's how you iron your pants in prison," Aroche said. "You iron it with the teeth of the comb … and then you put it underneath the mattress."


Aroche's first tattoo was a small cross on his left hand, in the soft web between thumb and forefinger. He got it in an alleyway not far from the studio apartment where he slept on the floor with his five brothers, three sisters, the occasional niece or nephew. His parents got the bed in the corner.


His Salvadoran mother was a chambermaid at a Fisherman's Wharf motel, his Puerto Rican father a security guard in the Navy shipyards.


And his older brothers? They would disappear for years. Aroche didn't know why until his father took him to visit San Quentin State Prison. They were "main men" in a notorious Northern California prison gang. When they were out, they were "the mayors of the Mission."


By the time Aroche was 15, he was drinking so much and incarcerated so often that he gave himself a test every night before he went to sleep. If he put out his hand and felt warm, smooth drywall, he knew he was home. If he felt cold, slick concrete, he was in custody.


One night he ended up in the hospital. He'd been drunk, hanging out in Lucky Alley, when a car drove up and the doors flew open. Aroche saw his friend get sliced with a machete. Gunshots rang out.


"And I remember some guy grabbing me and hitting me with a crowbar and stabbing me in my stomach," he said. "And I could feel the pierce of my stomach, just ripping me open.... And I thought, this is it. This is it. This is my life."

At the computer in his spartan office at the Hall of Justice, Aroche is poring over the official tale of another life in the balance: a 28-year-old woman on a downward spiral.

Park's makeover includes fruit trees for all to enjoy









Del Aire residents got to enjoy the fruits of their labor Saturday with the unveiling of the state's first public orchard.


Residents of this quiet, unincorporated slice of Los Angeles County had helped plant 27 fruit trees and eight grapevines in Del Aire Park and 60 additional fruit trees in the surrounding neighborhood. It was part of a larger renovation that included face lifts for a community center, basketball court and baseball field, all nestled in a green space just southwest of the juncture of the 105 and 405 freeways.


"Community gardens and farmers markets are truly the town centers of our communities," County Supervisor Mark Ridley-Thomas told the crowd of about 200 at the event. "These are the places where people gather and get to know each other."





The county paid $4 million for the improvements — and used a little creative financing. The fruit trees were paid for from funds designated for civic art. The purpose was to blend food and aesthetics into "edible art," Ridley-Thomas said.


A group of three artists, known as Fallen Fruit, helped design the orchard. "Art can be something more than something tangible," said David Burns, one of the artists. "It can actually be an idea. They really understood and embraced the fact that this art project was about the idea of share. This is about creating something that is abundant that has no ownership."


Another of the artists, Austin Young, said Boston, New York and Madrid are among the cities experimenting with edible landscaping. But in agriculture-rich California, Del Aire is the first place to follow suit, said Karly Katona, deputy to Ridley-Thomas. The idea is to create an edible landscape that will give the residents ownership and a stake in their park, she said.


Before its makeover, the park was something of a paradox. On weekends it bustled with families and children, but many came from other communities. They considered Del Aire Park a haven from the poorly maintained parks that had become gang hangouts in their neighborhoods.


By comparison, many Del Aire residents regarded the park as run-down. They often complained that the baseball diamond looked like a swamp from constant flooding, said John Koppelman, president of the neighborhood association.


So last summer, as the renovations took shape, Ridley-Thomas' office held events at the park to entice locals to enjoy the public space right in their backyard. Those included a "fruit jam" where residents were encouraged to bring food items that could go into a jam everybody shared. Residents also came to plant the trees, which include plums, pomegranates, limes, avocados and apricots.


Saturday morning, under a brilliant sun, the saplings were taking root in the freshly turned earth, wood stakes holding up the thin, bare trunks. The first edible fruit won't be ready to harvest for three years.


For now, a wooden sign overlooking the trees describes their purpose: "The fruit trees in this park belong to the public," it says. "They're for everyone, including you. Please take care of the fruit trees and when the fruit is ripe, taste it and share it with others."


After the dedication, Al Luna of Del Aire watched his two young daughters as they played on the jungle gym. The 42-year-old father said he loves having fruit trees across from his home.


"This is something we have never seen here," he said. "I know the public parks are very against having fruit trees in the parks, but I think this is a good idea. It will bring more people around and at least get free fruit out of it."

State parks officials deliberately hid millions, report says









SACRAMENTO — Fear of embarrassment and budget cuts led high officials at the California parks department to conceal millions of dollars, according a new investigation by the state attorney general's office.


The money remained hidden for years until it was exposed by a new staff member who described a culture of secrecy and fear at the department.


The attorney general's report, released Friday, is the most detailed official account so far of the financial scandal at the parks department. The controversy broke last summer with the revelation that parks officials had a hidden surplus of nearly $54 million at a time when the administration was threatening to close dozens of the facilities.





Although much of the accounting issues appeared to stem from innocent mistakes and discrepancies, the report said, about $20 million had been deliberately stashed away.


The report said the problem seemed to begin with calculation errors more than a decade ago. But when those mistakes were discovered in 2002, officials made a "conscious and deliberate" decision not to reveal the existence of the extra money, the report said.


Parks officials concealed the funds partly because they were embarrassed, the report said. But they were also worried that their funding would be cut further if state number-crunchers knew they had a larger reserve, according to interviews conducted by a deputy attorney general.


Parks officials underreported the amount of money they had to the Department of Finance, preventing lawmakers from including the extra funds in state spending plans.


The money "was intended to be a safety net," said Manuel Lopez, a former deputy director at the department, who was interviewed in the probe. Lopez resigned in May while being investigated for a separate scheme allowing employees to be improperly paid for unused vacation days.


Multiple high-ranking officials were involved in concealing the parks money, including Lopez and Michael Harris, the chief deputy director who was fired after the scandal broke. Evidence suggests that the initial decision to keep the money secret was made by Tom Domich, an assistant deputy director who left the department in 2004, the report said.


Domich "unpersuasively denies … his role in the deception," according to the report. The Times was unable to reach Domich on Friday.


Staff members who pointed out financial problems were ignored by their bosses.


"Throughout this period of intentional non-disclosure, some parks employees consistently requested, without success, that their superiors address the issue," the report said.


It is unclear whether ousted director Ruth Coleman knew about the accounting problems, the report said. She declined to be interviewed for the investigation; participation was voluntary for former parks personnel.


Officials have not yet determined whether criminal charges will be filed. There's no evidence that any money was stolen or used improperly, the report said.


The accounting problems were eventually exposed by Aaron Robertson, who started an administrative job at the parks department in January 2012. He told a deputy attorney general that people felt uncomfortable raising concerns at the department.


"There was a great deal of distrust," he said. "People felt somewhat fearful of coming forward with information."


John Laird, the California natural resources secretary who oversees the parks department, said new policies and staff are in place to prevent similar problems in the future.


"It is now clear that this is a problem that could have been fixed by a simple correction years ago, instead of being unaddressed for so long that it turned into a significant blow to public trust in government," Laird said in a statement.


A new parks director, retired Marine Maj. Gen. Anthony Jackson, was appointed by Gov. Jerry Brown to replace Coleman in November. Robertson was promoted to become his deputy.


The attorney general's investigation is the third report on the parks department in the last month. One more report, from the state auditor, is due this month.
